For returned goods without justified defects, a credit note will be issued amounting to 50% of the merchandise value. The merchandise value will be the price in effect on the date of return.

Claims concerning any kind of defects shall be made promptly and shall only be taken into account if they have been made within 8 days after receipt of the goods. The buyer shall make the claim in written to the seller (and not to a representative). Claims made later shall not be valid if they concern a so-called hidden defect.

The goods shall remain the property of Group Med GmbH & Co. KG until all existing principal and secondary claims as well as claims for compensation have been settled and checkes and bills of exchange have been honoured. If the buyer has resold the goods to third parties, the retention of title remains valid against the third party due to an extended retention of title. We reserve the right to remove the goods from the possession of the buyer at any time and at the buyer's expense.

The buyer shall insure the goods under retention of title against standard risks such as fire and theft and other possible risks and he or she shall produce the policy of insurance to the seller. The rights resulting from the insurance policy as far as they concern the transferred goods are to be seen assigned to the seller; this concerns in particular claims for payment against the involved insurance companies.
